These Terms of Service ("Terms") constitute a legally binding agreement between you (an individual or the entity you represent, "you" or "Customer") and Pool IQ ("Pool IQ", "we", "us", or "our") governing your access to and use of the Pool IQ software application, website, and related services (collectively, the "Service").
By (a) creating an account, (b) clicking "I agree" or similar, (c) accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
Pool IQ is a cloud-based pool service management platform designed for pool service professionals, technicians, and companies. Features include (depending on your plan):
We reserve the right to modify, add, or remove features at any time, with or without prior notice. Material reductions in functionality on paid plans will be communicated with at least 30 days' notice.
To use Pool IQ, you must create an account at pooliq.org/signup. You agree to:
You must be at least 18 years old to create an account. One person or entity may not create more than one organization account without our express consent.
Pool IQ offers the following subscription plans, billed monthly:

Annual pricing options may be available at a discount. Current pricing is always displayed at pooliq.org/pricing. We reserve the right to change prices with 30 days' notice to existing subscribers.
Subscriptions are billed monthly on the anniversary of your subscription start date. All payments are processed in USD via Stripe, Inc. By subscribing, you authorize Stripe to charge your payment method on a recurring basis.
Prices are exclusive of applicable taxes. You are responsible for any sales, use, or similar taxes imposed by your jurisdiction.
If a payment fails, we will retry the charge over 7 days. If payment remains unsuccessful, your account may be downgraded to the Free plan. You will retain access to your data. Paid features will become unavailable until a successful payment is made.
We may offer a free trial of paid plan features at our discretion. During a free trial:
Cancellation: You may cancel your subscription at any time through the Pool IQ app (Profile → Plans & Billing → Manage Subscription) or by emailing support@pooliq.org. Cancellation takes effect at the end of the current billing period. You retain access to paid features until the billing period ends.
Refund Policy:
Downgrading your plan may result in loss of access to features and data beyond the limits of your new plan. We are not responsible for data loss resulting from a voluntary downgrade.
You agree not to use the Service to:
Violation of this section may result in immediate suspension or termination of your account without refund.
Ownership: You retain all ownership of the data and content you input into Pool IQ, including client records, service logs, photos, and business data ("Your Content").
License to Pool IQ: You grant us a limited, non-exclusive, royalty-free license to store, process, display, and transmit Your Content solely as necessary to provide the Service. We do not use your business data for our own commercial purposes or to train AI models without your consent.
Responsibility: You are solely responsible for the accuracy, legality, and appropriateness of Your Content. You warrant that you have all necessary rights and permissions to store your clients' personal data in Pool IQ, and that you comply with applicable privacy laws (including GDPR and CCPA) with respect to your clients.
Data Export: You may export your data at any time via Settings → Backup & Export. After account deletion, data is retained for 30 days to allow for recovery, then permanently deleted.
The Service, including all software, algorithms, designs, logos, text, and features, is owned by Pool IQ and protected by copyright, trademark, and other intellectual property laws.
These Terms do not transfer any intellectual property rights to you. "Pool IQ" and the Pool IQ logo are trademarks of Pool IQ. You may not use our trademarks without our prior written consent.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes.
The Pool IQ mobile application ("App") is licensed, not sold, to you. This End-User License Agreement ("EULA") governs your use of the App, including the iOS and Android versions distributed via the Apple App Store and Google Play Store.
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely in connection with your Pool IQ account and subject to these Terms.
You may not: (a) sublicense, sell, or transfer the App; (b) modify, adapt, translate, or create derivative works based on the App; (c) reverse engineer, disassemble, or decompile the App; (d) remove any proprietary notices from the App.
If you download the App from the Apple App Store, the following additional terms apply:
If you download the App from Google Play, Google Play's Terms of Service and policies also apply to your use of the App.
We may release updates to the App from time to time. Updates may change functionality. Continued use of the App after an update constitutes acceptance of the update. Some updates may be required to continue using the Service.
The Service integrates with third-party services including Stripe (payments), Intuit QuickBooks (accounting), and mapping services. Your use of these integrations is subject to the respective third-party's terms of service and privacy policy. Pool IQ is not responsible for the practices of third-party services.
AI-powered features (chemical dosing recommendations, health analysis) use automated algorithms. These recommendations are provided for informational purposes only and do not constitute professional pool service or chemical advice. Always exercise professional judgment and verify readings independently.
We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) any AI-generated chemical recommendations are accurate or safe; (c) data stored in the Service will be free from loss or corruption; (d) the Service will meet your specific requirements.
AI-powered chemical dosing recommendations are provided as suggestions only. Pool IQ is not liable for any chemical imbalances, equipment damage, property damage, personal injury, or any other harm resulting from reliance on AI recommendations. Always verify chemical readings with calibrated testing equipment.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO POOL IQ IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In those jurisdictions, our liability will be limited to the fullest extent permitted by law.
You agree to defend, indemnify, and hold harmless Pool IQ and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service in violation of these Terms; (b) Your Content; (c) your violation of any third-party right, including any intellectual property right or privacy right; or (d) your violation of any applicable law.
By you: You may terminate your account at any time by contacting support@pooliq.org or using the account deletion option in the app.
By Pool IQ: We may suspend or terminate your account immediately, without prior notice, if you: (a) violate these Terms; (b) engage in fraudulent activity; (c) your account has been compromised; or (d) we are required to do so by law.
Upon termination: (a) your right to use the Service immediately ceases; (b) we will retain your data for 30 days to allow for account recovery; (c) after 30 days, your data will be permanently deleted (except data we are legally required to retain).
Provisions of these Terms that by their nature should survive termination shall survive, including Sections 8, 9, 12, 13, 14, 16, and 17.
Informal Resolution: Before filing a formal claim, you agree to contact us at support@pooliq.org and attempt to resolve the dispute informally. Most concerns can be resolved this way within 30 days.
Binding Arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration, not in court, except that either party may bring individual claims in small claims court.
Class Action Waiver: You agree to resolve disputes with Pool IQ on an individual basis and waive the right to participate in a class action lawsuit or class-wide arbitration.
Exceptions: The arbitration agreement does not apply to claims for injunctive relief related to intellectual property infringement.
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. You consent to personal jurisdiction in the state and federal courts located in Arizona for any disputes not subject to arbitration.
We may update these Terms from time to time. When we make material changes, we will: (a) update the "Last updated" date at the top; (b) send an email notification to your account email; (c) show an in-app notice on your next login. Your continued use of the Service after the effective date constitutes acceptance. If you disagree, you may cancel your account.
